Welcome to MakeupPlus! Before you join our "User Experience Improvement Program," please read the following terms:
MakeupPlus' "User Experience Improvement Program" (hereinafter referred to as "the Program") is a voluntary program launched by Meitu, which is designed to improve the relevant technology and services of MakeupPlus and enhance user experience without affecting the usage of MakeupPlus. After joining the Program, you will not only experience the original functions of MakeupPlus, but also enjoy a more optimized and customized experience based on the particular facial data and behavioral habit acquired during your use of MakeupPlus.
This Agreement may be modified from time to time as required by Meitu, and any modifications will be accessible to users on the official website of MakeupPlus. If you disagree with the modification to this Agreement, you can stop using the program at any time. Any usage therefore after the 15 days notice of the modification will be regarded as your consent for the modification.
A. Facial data information
Reason for collection: Meitu uploads your particular facial data information to its database, conducts standard evaluation and assessment according to the face recognition algorithm developed by Meitu and makes a comprehensive evaluation and analysis on the existing face recognition technology. This is done in order to improve research and enhance the automatic facial recognition, beautification and makeup technology.
B. Cookies and similar technologies. When Meitu requests an advertiser or other partner to deliver ads to or offer services for your equipment, Meitu or the third party may apply cookies and similar technologies that you use;
C. Equipment or software information, such as the configuration information provided by your mobile equipment, web browser, or other program used to access our services, your IP address and the version and identifier of the mobile equipment used, operation system information, and network information;
D. Information related to mobile applications (apps) and other software that you have applied, and the information about such mobile applications and software that you have used.
E. Information (metadata) involved in the contents that you share through our services, such as the date, time, place, and others of captured and shared photos or videos.
F. Functional Requirements
According to the product requirements, Meitu will access your camera and activate its functions, access the photo album for loading and saving images, and enable recording and camera functions to capture videos, while accessing relevant functions of your mobile device to ensure the normal use of the product.
After you receive the "User Experience Improvement Program" interactive notification from MakeupPlus, clicking [Join] means you agree to join the Program and accept all terms and conditions of User Agreement of the Program; otherwise the Program will not work. If you agree first and then are not willing to join in the Program anymore, you can click [about MakeupPlus] to cancel the tick of [User Experience Improvement Program] manually and consequently Meitu will no longer upload your photos to the relevant server.
Meitu will strictly abide by the related State laws and regulations. The collection of related data information under the Program will be completely anonymous and Meitu promises that it will not match and store the collected information or any other personal information. Meitu collects and uses the related information only for customizing your experience and improving the technologies of MakeupPlus. We shall never push any information unrelated to the software and service to you or use the collected information in product marketing, profit-making or promotion activity. Meitu will keep the collected information strictly confidential without providing it to any third party.
You understand and agree that because of the particularity of the Program, Meitu hereby suggests you do not shoot or take any pictures with MakeupPlus that you are unwilling to be known by any third party you post to after voluntarily joiningthe Program. Consequently, you shall not claim any infringement toyour privacy rights.
You understand and agree that you have fully considered the leakage risk of data provided and transmitted through the network and are willing to take the risk. You hereby confirm that you will undertake the consequences of data leakage caused by network transmission yourself. Meitu will assume no responsibility for data leakage beyond the control or through no fault of Meitu.
You understand and agree that Meitu will regard you as the sole legal oblige upon the pictures shot and made by you in MakeupPlus (including but not limited to copyright and portraiture rights) or you have acquired permission from the original oblige of such pictures after you join in the Program voluntarily. In case that Meitu uploads the related information to server according to this Agreement and thereby infringes any third party's right, you shall be responsible for resolving any issues and compensate Meitu regarding any third party's claims.
In view of any dispute arising between you and Meitu, you shall agree to settle the dispute under exclusive jurisdiction of the local People's Court with competent jurisdiction where Meitu is located, provided that the location of Meitu is permitted by applicable laws and policies to act as the only or one of locations of dispute jurisdiction during the dispute occurs. Meanwhile, in the case that Meitu intends to bring a lawsuit against you or other third party on disputes related to this Agreement or MakeupPlus, Meitu shall have the right to choose the local People's Court with jurisdiction where Meitu is located for exclusive jurisdiction of such disputes.
A. Meitu: When it concerns (and only when it concerns) the rights available to Meitu pursuant to this Agreement, the "Meitu" referenced in this Agreement may include but is not limited to Xiamen Meitu Technology Co., Ltd. and/or its affiliates and the staff members of Xiamen Meitu Technology Co., Ltd. and/or that of its affiliates. Especially, in the case that the above affiliates and/or their staff members suffer losses due to user's misuse of MakeupPlus, these affiliates and/or their staff members are entitled to claim the corresponding rights against users according to this Agreement.
B. MakeupPlus: according to different context, the "MakeupPlus" referenced in this Agreement may refer to the software product of MakeupPlus or the independent website established by Meitu for MakeupPlus or the relevant technical service supplied by Meitu around the software product of MakeupPlus.
C. "You": "You" under this Agreement refers to individual user or institutional user who determines to accept all the terms and conditions of this Agreement after reading this Agreement carefully. Before you choose to join in the Program voluntarily, you shall make sure yourself belong to the person with full capacity for civil conduct as prescribed by applicable laws; otherwise you shall use MakeupPlus in the presence of your guardian.
D. Applicable law: Laws and policies of the People's Republic of China (excluding Hong Kong, Macao and Taiwan) shall apply to any matters related to this Agreement ("applicable laws and policies"). These applicable laws and policies may be in a dynamic change process, therefore it shall not constitute a basis for natural invalidity or termination of enforceability of all or any clause of this Agreement in case the rights and interests of yourself and/or Meitu under this Agreement increase or decrease due to changes of applicable laws and policies, unless the above changed applicable laws and policies belong to effective and mandatory provisions.
